Attachment may be necessary if assets available to satisfy a specific entitlement threaten to disappear. It can also block the very sale needed to pay creditors. An heir therefore cannot have the entire estate frozen without further assessment. A lawyer investigates who your debtor is, which assets can be attached and how executorship or liquidation affects matters. If a transfer threatens, immediately collect the evidence and planned date.

1. Start with your claim and the correct opposing party
Suspecting your brother is withholding money is not yet a defined claim for attachment. Your lawyer must determine precisely what you seek: repayment to the estate, payment of your own monetary claim, transfer of an asset or protection of a share. This difference determines whom you act against and what attachment is possible. Therefore list the amount, legal basis, payment obligation and documents you rely on.
Then establish whether you can act independently and who represents the estate. A claim of the joint heirs against a third party differs from your personal entitlement against a co-heir. Nor is a reserved-portion claim an ownership share in every estate asset. Have standing assessed before identifying a bank account or home. An incorrect opposing party may jeopardise both the attachment and subsequent main proceedings. Therefore also state whether you act for yourself or seek to protect an estate interest, and what response you have already received from the authorised administrator.
2. Choose the attachment asset by ownership and purpose
Attachment of a bank account, a home and a share in an undivided estate have different effects. Check who legally owns the rights. An heir's private account does not become an estate account merely because of a family dispute. Conversely, estate assets cannot simply secure a personal debt of one heir. Supply account details and ownership documents without seeking unauthorised access to someone else's records.
Also describe the specific danger the attachment should limit. For an announced home transfer, the purchase agreement and conveyance date matter; for a threatened transfer of money, messages and lawfully obtained bank statements may help. The lawyer assesses whether the chosen measure suits your entitlement and does not freeze unnecessarily many assets. Targeted security may be more practical than a freeze leaving mortgage payments, taxes or necessary maintenance unpaid.
3. Check the roles of executor and liquidator
Read the will, certificate of inheritance and any judicial appointment order together. An executor manages within their role and pays estate debts; a liquidator administers with particular regard for creditors. Keeping the records does not prove unlimited authority to represent. Also ask whether there has been acceptance under benefit of inventory and which administration rules actually apply. This information affects against whom an application or claim must be directed.
Special rules on recovery and existing attachments apply during liquidation. Attachment is then no simple way to get ahead of other creditors. Your lawyer must investigate the consequences for collective administration and assess whether an existing freeze can be lifted. Therefore immediately discuss any appointed liquidator with your adviser. Withholding that information makes the factual presentation in an attachment application incomplete and may cause unnecessary costs.
4. Conservatory attachment requires a lawyer and court permission
Conservatory attachment keeps assets available during a dispute. The Dutch judiciary explains that a lawyer submits an attachment application to the district court. Among other things, it identifies the assets to be attached and why the measure is needed. Permission therefore requires legal substantiation; a bailiff does not independently decide whether your inheritance entitlement suffices. Discuss known defences and existing agreements fully with the lawyer.
The court frequently decides without a prior hearing, but that guarantees neither permission nor a decision within a few hours. Following permission, the bailiff actually levies the attachment. Permission is also not final acknowledgement of your claim. If main proceedings are necessary, they must begin within the period set by the court. Have that deadline diarised immediately and agree beforehand who prepares the next steps.
5. Urgency requires a timeline and workable follow-up
For an impending sale or withdrawal, make a short timeline of verifiable facts. Record what the documents show will happen, on what date, by whom and why later recovery may become harder. Attach relevant correspondence and mark information that is only suspected. A clear conveyance date helps a lawyer assess urgency. Merely saying you distrust the other heir offers little basis for an appropriate measure.
At the same time, ask about what follows attachment. Sometimes an escrow arrangement, bank guarantee or other security better fits the dispute. Whether offered security suffices depends on your claim and its terms. Also have it assessed whether an information claim or interim management arrangement is necessary. Attachment does not automatically provide access to all records or immediately deliver the disputed inheritance share; at most it preserves the possibility of recovery.
6. An attachment on an estate home can be lifted
In ECLI:NL:RBMNE:2018:1001, a court-appointed liquidator sought the lifting of tax attachments on an estate home. The estate was insolvent and the home had to be sold and conveyed to pay debts. The subdistrict court lifted the attachments because this was necessary for liquidation. The Dutch Tax Administration ultimately did not oppose the request and acknowledged that it should have cooperated in lifting them earlier.
This decision shows that attachment cannot indefinitely obstruct collective administration's purpose. It gives heirs no general right to remove every attachment with a simple letter. It concerned an appointed liquidator's application, specific enforcement attachments and a necessary sale in an insolvent estate. Therefore establish the correct applicant, court and legal basis; ordinary lifting proceedings may require a different route.
7. Defence and costs form part of the decision
Anyone facing attachment should collect the permission order, application, bailiff's writs and evidence of the alleged claim. Have it examined whether the debt is sufficiently plausible, the correct asset was affected and what security or ground for lifting is available. The judiciary also describes urgent proceedings for lifting attachment. A full assessment may extend beyond whether you actually owe money; interests and consequences of the freeze also count.
Budget lawyer's fees, court fees and bailiff's costs for both attachment and main proceedings. A lifting dispute and security costs may be additional. Ask who commissions the work and whether costs are incurred personally or on behalf of the estate. Costs do not automatically fall entirely on the other party. Wrongful attachment may also raise liability issues. Therefore weigh the value of your interest against the risk of the chosen freeze beforehand.
8. Prepare a focused attachment file for the first consultation
Bring the will, certificate of inheritance, acceptance details and appointments, alongside your calculation of the entitlement. Add bank statements, ownership information, sale documents and relevant messages. Keep complete documents with dates and senders. A table with columns for established amount, disputed amount and missing evidence helps more quickly than isolated screenshots without context. Also state which earlier proceedings are ongoing and what judgment or agreement resulted from them.
Finally, define your desired outcome: keeping money available, enabling a sale or ending an unfounded freeze. Ask the lawyer for an initial assessment of legal basis, authority, attachment asset, necessity and follow-up budget. Agree when you will communicate new information, especially changes to a conveyance date. This keeps the measure linked to the actual problem and permits timely choices of narrower attachment, replacement security or another procedure.
Frequently asked questions
Can I have the entire estate frozen as an heir?
This does not automatically follow from heirship. A lawyer investigates your specific entitlement, correct opposing party, attachment asset and applicable administration rules.
Does conservatory attachment give me my money immediately?
No. Attachment preserves assets for possible recovery. The merits of your claim must, where necessary, be assessed in the main proceedings.
Can a liquidator have an existing attachment lifted?
Under statutory conditions, this is possible where lifting is necessary for liquidation. Decision RBMNE:2018:1001 provides a specific example, not an automatic outcome for every case.
